Terms of Use

In short: Tvorya is a tool for creating personalised digital products — invitations, cards, caricatures, art prints and more — with the help of AI. These Terms are the agreement between you and us. By using Tvorya, you accept them. The plain-language notes like this one are summaries only; the full text is what is binding.

1. Who we are

Tvorya ("Tvorya", "we", "us", "our") is a digital art studio that lets you create personalised digital products — such as invitations, greeting cards, caricatures and art prints — by describing what you want, generating a design with artificial intelligence, and personalising it in our editor.

Tvorya is operated by ДИГИТАЛНО АТЕЛИЕ ТВОРЯ ЕООД (DIGITAL ATELIER TVORYA EOOD), a single-member limited liability company registered in Bulgaria in the Commercial Register (Търговски регистър) under EIK 208876264, with its registered address at ул. Стадионска № 7, вх. Б, ет. 3, ап. 24, 6600 Кърджали (Kardzhali), Bulgaria. You can reach us at support@tvorya.com or through the contacts in our Help Center.

These Terms of Use ("Terms") govern your use of the Tvorya website and service (the "Service"). They work together with our Privacy Policy, AI Terms, Acceptable Use Policy, Cookies Policy, Refunds and Content & IP Policy, all of which form part of your agreement with us.

2. Accepting these Terms

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service. We may update these Terms from time to time — see "Changes to these Terms" below.

3. Who may use Tvorya

In short: You need to be old enough to enter into a contract. Tvorya is not made for children.

You must be at least 18 years old to make a purchase on Tvorya. If you are under 18, you may only use the Service with the involvement and consent of a parent or guardian who agrees to these Terms on your behalf.

The Service is not directed at children. We do not knowingly allow children under the age of 14 to create an account or provide personal data. See our Privacy Policy for more.

By using the Service, you confirm that you are legally able to enter into this agreement and that the information you give us is accurate.

4. Your account

Some features require an account. You are responsible for keeping your login details secure and for everything that happens under your account. Tell us promptly if you believe your account has been used without your permission.

You may close your account at any time. We may suspend or close your account as described in "Suspension and termination" below.

5. How you may use the Service

In short: Use Tvorya for its intended purpose, and don't misuse it or try to break it.

You are granted a personal, limited, non-exclusive, non-transferable and revocable right to use the Service for creating your own products. You agree not to:

• use the Service in any way that breaks the law or our Acceptable Use Policy;
• copy, resell, sublicense or redistribute the Service itself;
• reverse-engineer, scrape, data-mine, or attempt to extract the underlying systems, models or content of the Service;
• build or train a competing product or AI model using the Service or its outputs;
• bypass, disable or interfere with any security, rate limit, watermark, or access control we put in place;
• upload viruses or malicious code, or otherwise disrupt the Service.

6. Your content and what you create

In short: What you put in and what you make is yours. You give us only the permissions we need to run the Service for you, and you confirm you have the right to upload whatever you upload.

Your content. Anything you type, upload, or provide to the Service — including event details and any images you upload — is "Your Content". As between you and us, you keep all rights you have in Your Content.

Your rights warranty. You confirm that you own or have all necessary rights, licences and permissions for Your Content, and that uploading and using it through the Service does not infringe anyone else's rights (including copyright, trademark, privacy or image/likeness rights). This is especially important when you upload photographs of people — see our AI Terms and Acceptable Use Policy.

The licence you give us. To operate the Service, you grant us a worldwide, royalty-free licence to host, store, copy, process, display and transmit Your Content — solely to provide and improve the Service to you, to deliver your products, to keep the Service safe and secure, and to enforce our policies. Where you choose to share a product, this licence continues to the extent needed to keep that product available.

What you make. The products you generate and personalise ("Your Creations") are yours to use, subject to these Terms and our AI Terms. Because Your Creations are produced by AI, important points about ownership, uniqueness and accuracy are set out in the AI Terms — please read them.

7. AI-generated content

Tvorya creates designs using artificial intelligence. Your use of these features is also governed by our AI Terms, which explain ownership of outputs, the rules for prompts and uploads, the role of our AI provider, and important disclaimers about accuracy. To deliver AI features, some of Your Content (such as your prompts and any uploaded images) is shared with our AI provider — see the AI Terms and Privacy Policy.

8. Buying, prices and payment

In short: Some products are paid. Prices are shown before you buy, in euros, including applicable taxes.

Certain products and features are available for a one-off purchase. The price and any applicable taxes are shown before you confirm your order. Payment is processed by our payment provider; we do not store your full card details.

You agree to provide accurate billing information. If you request an invoice, you are responsible for the accuracy of the company and tax details you provide.

9. Refunds

Because the products you create are personalised by you and are delivered to you instantly as digital files, purchases are final once delivery has begun. We do, however, stand behind genuine failures on our side. The full policy — including your statutory consumer rights — is in our Refunds page.

10. Our intellectual property

The Service itself — including the website, software, AI systems, branding, and any content we provide — belongs to Tvorya and its licensors. Nothing in these Terms transfers ownership of the Service to you. If you send us feedback or suggestions, you allow us to use them freely to improve Tvorya.

11. Availability and changes to the Service

We work to keep Tvorya available and reliable, but we provide it on an "as is" and "as available" basis. We may add, change, limit or remove features, or suspend or discontinue the Service, at any time. Where this materially affects a product you have paid for and not yet received, your statutory rights and our Refunds policy apply.

12. Disclaimers

To the maximum extent permitted by law, we do not warrant that the Service will be uninterrupted, error-free, or that outputs will meet your expectations. AI outputs are generated automatically and are not reviewed by us for accuracy — see the AI Terms. This section does not exclude any rights you have as a consumer that cannot be excluded by law.

13. Our liability to you

In short: We don't limit liability where the law doesn't allow it. Otherwise, our liability is limited.

Nothing in these Terms limits or excludes our liability where it would be unlawful to do so — including liability for death or personal injury caused by our negligence, for fraud, or for any consumer rights that cannot be waived under Bulgarian or EU law.

Subject to that, we are not liable for indirect, incidental, special or consequential losses, or for loss of profit, data or goodwill. Where we are liable, our total liability to you in connection with the Service is limited to the amount you paid us in the twelve months before the event giving rise to the liability, or EUR 50, whichever is greater.

14. Your responsibility (indemnity)

To the extent permitted by law, you agree to be responsible for any claims, losses or costs we reasonably incur because of Your Content or your breach of these Terms or our policies.

15. Suspension and termination

We may suspend, restrict, or end your access to the Service — and remove content — if you breach these Terms or our Acceptable Use Policy, if required by law, or to protect the Service, other users, or third parties. You may stop using the Service and close your account at any time. Where your account is closed, you may lose access to your content and creations, subject to our Privacy Policy retention rules.

16. Privacy

How we handle your personal data is explained in our Privacy Policy. For products that involve uploading photographs of people, please pay particular attention to the consent and rights requirements in our AI Terms and Acceptable Use Policy.

17. Complaints and disputes

If something goes wrong, please contact us first through the Help Center — we want to put it right. If we cannot resolve it, you may also be entitled to refer the matter to the competent Bulgarian consumer-protection authority (the Commission for Consumer Protection / Комисия за защита на потребителите) or another alternative dispute resolution body. Nothing here affects your statutory rights.

18. Governing law

These Terms are governed by the laws of the Republic of Bulgaria and applicable European Union law. Mandatory consumer-protection rules of the country where you live continue to apply to you.

19. Changes to these Terms

We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date and, where appropriate, notify you. By continuing to use the Service after changes take effect, you accept the updated Terms.
